Freedom of Information and Protection of Privacy
Alberta University of the Arts (AUArts) is subject to the Freedom of Information and Protection of Privacy Act (“FOIP” or “the Act”) under section 1(d) of the Act; as such, AUArts is committed to ensuring the lawful and consistent collection, use, disclosure, and protection of information under its custody and control.
The Access to Information and Protection of Privacy Policy authorizes and informs users of information in the custody of AUArts to operate in accordance with the act.
What is FOIP?
The Freedom of Information and Protection of Privacy (FOIP) Act is Provincial legislation that has three parts...
- Freedom of Information or Part 1 of the Act, provides people with a right-of-access to records in the custody or control of public bodies, subject to specific exceptions set out in the Act. Alberta University of the Arts is a public body under the FOIP Act.
- Protection of Privacy or Part 2 of the Act, provides the rules and provisions that control how Alberta University of the Arts may operationally collect, use, and disclose personal information in order to protect the privacy of individuals. Part 2 also provides a process for individuals to request access to and corrections of their own personal information.
- Roles and Powers of Information and Privacy Commissioner and Reviews and Complaints or Part 3 of the Act, outlines the role and powers of the Information and Privacy Commissioner as well as how to pursue reviews and complaints regarding access to information or protection of privacy.
Collection of information
AUArts may collect information about you through various sources.
Collection occurs when AUArts gathers, acquires, receives, or obtains personal information. For example, it includes activities where individuals respond through interviews, questionnaires, surveys, applications, or by completing forms in order to provide information. FOIP does not permit collection of personal information "just in case" it may have value in the future, the program may be expanded in the future or someone in the public body may ask for the information at some point in the future.
Under FOIP, the University must collect personal information directly from the individual the information is about except under specific circumstances. FOIP also states that whenever the University collects personal information from the individual, it must tell the individual what authority it has to collect the information, how the information will be used, and finally, who can be contacted if there are any questions about the collection or use of the information.
